What a Private Investigator Can — and Cannot — Legally Do in Arizona
There are a lot of myths about what PIs can do. Here's a plain-language breakdown of the legal boundaries of private investigation in Arizona — what's allowed, what's not, and how a licensed PI protects you.
Private investigators in Arizona are licensed by the Arizona Department of Public Safety under ARS Title 32, Chapter 24. Operating without a license is a Class 1 misdemeanor. When you hire a licensed PI, you're hiring someone who has passed a background check, met experience requirements, and is legally accountable for their conduct.
What a PI CAN do: conduct surveillance from public spaces, photograph or video record individuals in public, access public records (court filings, property records, business registrations), conduct interviews, run professional database searches, and testify in court about their findings.
What a PI CANNOT do: trespass on private property, wiretap or record phone calls without consent (Arizona is a one-party consent state for in-person conversations, but federal law governs phone interception), impersonate law enforcement, access private financial records without authorization, or hack into email or social media accounts.
One-party consent in Arizona means that if you are a party to a conversation, you can legally record it without telling the other person. A PI cannot record a conversation they are not part of. This is a critical distinction that affects how evidence is gathered in infidelity and custody cases.
Evidence gathered illegally is not only inadmissible in court — it can expose you and your investigator to criminal liability. A licensed PI's value is not just in what they find, but in how they find it. Legally obtained evidence holds up. Illegally obtained evidence destroys cases.
If you're considering hiring a PI, ask to see their license number and verify it with the Arizona DPS. Ask how they plan to gather evidence and whether their methods will hold up in court. A reputable investigator will answer these questions without hesitation.
